No. You might think that Beatrice is operating an illegal childcare service because she receives seven children daily for childcare. However, it must be understood that Beatrice's children should not be included in the calculation. In fact, she is legally providing childcare services to five children.
2. Colette is a grandmother at home who is not recognized by a CO as an HCP. At lunchtime, she receives eight children who attend the elementary school located near her family residence. Is Colette operating an illegal childcare service?
Yes. By providing childcare services to more than six children (eight children), Colette is in an illegal childcare situation. To comply and operate a legal childcare service, she should apply for recognition from a CO or reduce the number of children received to six.
3. Gisèle has filed permit application with the Ministère de la Famille. The Department has not rendered a decision yet. While waiting to receive her permit, Gisèle continues to provide childcare services to 28 children at her facility. Is Gisèle operating an illegal childcare service?
Yes. Applying for a permit does not exempt a person from compliance with the ECA. Until her permit is issued, Gisèle will have to reduce the number of children received to six in order to comply with the Act and operate a legal childcare service.
